Abstract

Introduction: Criminal law is one of the independent parts of public law which is one of the most important legal instruments in existence since ancient times. Because this law is very important in ensuring public safety from the threat of criminal acts, maintaining state stability and even being a "moral institution" that plays a role in rehabilitating criminal offenders.

Purposes of the Research: The purpose of this study is to analyze and explain the views of Indonesian criminal law on sexual relations on the basis of consensual sex, as well as to analyze and explain the formulation of sexual acts on the basis of consensual sexual relations in the context of Indonesian Criminal Law.

Methods of the Research: The research method used is normative juridical. The problem approach used is the legislative approach, the conceptual approach, and the case approach. The source of legal materials used is primary legal materials and secondary legal materials. The technique of collecting legal materials through literature studies and then analyzed through descriptive methods using qualitative analysis.

Results Main Findings of the Research: The results of the study show that the Criminal Code that applies in Indonesia, does not specifically regulate sexual relations on the basis of consensuality. Where consensual sexual acts to minors outside of marriage can be prosecuted under Article 293 paragraph (1) of the Criminal Code where an adult is based on Article 330 of the Civil Code is a person who is not even 21 years old and has never been married, as well as Article 284 of the Criminal Code regarding adultery (overspel). That in Article 411, and Article 412 of Law Number 1 of 2023 concerning the Criminal Code is also not in accordance with the concept of adultery in society. Seeing this, it must be believed that the relevant law is a law that is in accordance with the values of society and the law must be positioned for human beings not human beings for the law
