BATULIS Civil Law Review is an open-access and peer-reviewed journal, managed and published by the Faculty of Law, Universitas Pattimura. It aims to provide a platform to share insights, innovations, and critical approaches from the results of legal research in Indonesia and across countries, in analyzing interactions, applications, and adaptations in resolving complex contemporary issues in the field of civil law related to Economic/Business Law, Land Law, and Agrarian Law in its development, triggering the evolution in civil law. Therefore, the main focus of BATULIS Civil Law Review is to comprehensively examine how the principles of civil law become an essential foundation for various legal domains, especially in the context of Economic/Business Law and Land and Agrarian Law.
Scope
The scope of BATULIS Civil Law Review covers various aspects and contexts related to Civil Law in the Field of Economic/Business Law and Land and Agrarian Law, including but not limited to:
- Basic Principles of Civil Law: Core concepts such as legal subjects, legal objects, rights and obligations, principles of freedom of contract, good faith, and protection of rights. The legal basis of an agreement is the basis for transactions in various fields. Material law relevant to the ownership of assets, guarantees, and property rights.
- Family and Inheritance Law: The civil law implications regarding marriage, divorce, and inheritance on the ownership structure of business assets and property, including land. Prenuptial agreements or property separation agreements that impact business assets and land.
- Business and Commercial Agreements: Analysis of different types of business contracts (commercial buying and selling, distributors, licenses, franchises, cooperation, financing). Elements of the validity of business agreements, performance of achievements, defaults, and settlement of business-specific civil disputes.
- Protection of Intellectual Property Rights: how the principles of civil law in Intellectual Property Rights protect the work of individuals or certain groups, reward creativity, and encourage innovation that covers different types of protected intellectual property, namely: Copyrights, Patents, Trademarks, Industrial Design, Trade Secrets, Integrated Circuit Layout Design, and Geographical Indications.
- Consumer Protection in Business Transactions: How civil law principles support consumer protection in business transactions. Resolution of consumer disputes related to business products or services.
- Protection of Personal Data in a Business Context: The right to privacy and protection of personal data relevant to companies. The company's civil liability for personal data breaches.
- Corporate Law: The relationship between shareholders, directors, and companies. Agreements that bind the company and personal responsibilities in certain situations.
- Land Rights Based on Civil Law: An in-depth study of property rights, use rights, and other material rights over land as regulated in civil law. Analysis of the principles of transfer of land rights, including sale and purchase, grants, and inheritances, and their implications for ownership.
- Land Acquisition for Public Interest: Analysis of civil law aspects in the land acquisition process, including the determination of fair and appropriate compensation values based on civil law principles. A study of agreements related to land acquisition and potential civil disputes. Settlement of land-related civil disputes in the context of the development of national strategic projects.
- Land and Agrarian Agreements: A study of land lease agreements, land use cooperation agreements, and other agreements related to land. Analysis of the validity, implementation, and violation of these agreements from a civil law perspective.
- Agrarian Law in the Context of Economics and Business: A study of how the right to land and agrarian resources becomes an important object in investment and economic/business activities. Analysis of agrarian regulations and how the principles of civil law and economic/business law are applied in the control and use of land commercially. The study of land disputes arising from economic or business activities.
